TERMS AND CONDITIONS

STANDARD DATA AND TEXT MESSAGING RATES MAY APPLY

1. Eligibility: The Bush’s Beans Your Fam on a Can Offer (The “Offer”) is open only to legal residents of the 50 United States and the District of Columbia (“Eligibility Area”), who are 18 years of age or older at the time of registration. Employees, shareholders, directors, officers, members and agents of Bush Brothers & Company (“Sponsor”), Zeno Group, Inc., Don Jagoda Associates, Inc. (“Administrator”), and their respective affiliates, parents, subsidiaries, divisions, suppliers, retailers and advertising, promotional and judging agencies (collectively, the “Released Offer Parties”), and their immediate family members (spouse and parents, children, siblings and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible to participate or receive a premium. Void outside the Eligibility Area and where prohibited or restricted by law and subject to all applicable laws and regulations. Participation constitutes participant’s full and unconditional agreement to these Terms and Conditions.

2. Promotion Timing: The Offer begins at 10:00 am ET on March 19, 2025 and ends at 11:59 pm ET on April 30, 2025 (“Promotion Period”) or while supplies last, whichever occurs first. The Promotion Period includes three (3) separate non-consecutive offer periods (each, an “Offer Period”), each with a specific number of Offer premiums available as outlined below. Any unclaimed Offers at the end of one Offer Period will be carried forward to subsequent Offer Period(s), if any remain. Administrator's computer is the official time keeping device for this Offer.

Offer Period 1: 10:00 AM ET on March 19, 2025, through 11:59 PM ET on March 25, 2025; 3,500 premiums available.

Offer Period 2: 10:00 AM ET on March 26, 2025 through 11:59 PM ET on April 1, 2025; 2,500 premiums available.

Offer Period 3: 10:00 AM ET on April 2, 2025 through 11:59 PM ET on April 30, 2025; 1,500 premiums available.

3. The Offer: During the Offer Period, participants can participate in the Offer by visiting YourFamOnACan.dja.com (“Website”) and completing all required registration information including their full name, email address, mailing address, and their front label name (up to 20 characters) and submitting the form as instructed (“Registration”). Participants that are one of the first designated number for each Offer Period to register during each Offer Period will receive a customized Bush’s Beans can (which will be empty, i.e. not contain food) with a personalized front label name (“Premium”), subject to verification of eligibility. Only eligible Registrations submitted will be sent the Premium after they have been validated. In no event will Sponsor be obligated to award more than 7,500 Premiums (as broken out above). There is a limit of one (1) Registration per person/household per Offer Period. Standard data and text messaging rates may apply.

Once a Registration has been validated, Premiums will be mailed to recipients via U.S. mail at the mailing address provided. Return of any Premium as undeliverable will result in forfeiture of Premium.

Any attempt by any participant to submit a Registration by using multiple/different names, identities, email addresses, or any other methods will void such Registration and that participant (and/or mailing and email addresses associated therewith) will be ineligible for the Offer.

4. Premium: Up to Seven thousand five hundred (7,500) Premiums (broken out per Offer Period as stated above) - A customized Bush’s Beans can with a personalized front label name (Approximate Retail Value: $.50 each). Please note, the can is empty and meant for display only. Can and “product” styles may vary. There is a limit of one (1) Premium per participant/household per Offer Period. Premium is subject to availability, while supplies last. No transfer, cash or other substitution of a Premium except Sponsor may substitute Premium in whole or in part for one of comparable or greater retail value for any reason in its sole discretion.

Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning the Premiums. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE PREMIUMS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

5. General Terms: By participating in this Offer, participants agree: [a] to abide by and be bound by these Terms and Conditions and decisions of the Released Offer Parties which shall be final in all respects relating to the Offer, including without limitation the interpretation of these Terms and Conditions; [b] to assume all liability for any injury or damage caused, or claimed to be caused, by participation in the Offer or use or misuse of the Premium; [c] to release, discharge and hold harmless the Released Offer Parties from any and all injuries, liability, losses, damages, rights, claims and actions of any kind including liability for property damage, personal injury or death resulting from their participation in the Offer or their acceptance, use or misuse of a Premium; and [d] if a Premium recipient, to the use of their name, voice, image and/or likenesses for advertising, publicity and promotional purposes by Sponsor and Sponsor's subsidiaries and affiliates without further compensation (unless prohibited by law) and to execute specific consent to such use if asked to do so. The Released Offer Parties are not responsible and shall not be liable for [a] electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction; [b] technical, network, telephone equipment, electronic, computer, hardware or software malfunctions; [c] damage to the Premium by any cause, including shipment; [d] use or misuse of the Premium; and [e] limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof. Sponsor and/or Released Offer Parties are not responsible for incomplete, not received, misdirected, or illegible requests or claims or any condition caused by events beyond the control of the Sponsor that may cause the Offer to be disrupted or corrupted. If, for any reason whatsoever, this Offer, in Sponsor's sole opinion, is not capable of running as planned, including, but not limited to, by reason of equipment tampering, fraud, or any other cause which, in the Sponsor's sole judgment, corrupts or affects the security, fairness, integrity or proper conduct of this Offer, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Offer and terminate awarding of Premiums, but all those Registrations submitted validly prior to cancellation will still be fulfilled. Sponsor may prohibit a participant from participating in the Offer or receiving a Premium if, in its sole discretion, it determines that said participant is attempting to undermine the legitimate operation of the Offer by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants, Sponsor, or Released Offer Parties. CAUTION: ANY ATTEMPT BY AN PARTICIPANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE OFFER MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

6. Disputes; Governing Law. Participants waive all rights to trial in any action or proceeding instituted in connection with these Terms and Conditions, including, without limitation, the Offer. Any controversy or claim arising out of or relating to these Terms and Conditions and/or the Offer shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the state of Tennessee.

7. Sponsor/Administrator: The Sponsor of the Offer is Bush Brothers & Company, 1016 Welsgarber Road, Knoxville, TN 37909. The Administrator of the Offer is Don Jagoda Associates, Inc., 100 Marcus Drive, Melville, NY 11747.
